Prejudice and racism reared its ugly head in many areas of society, with people showing a tolerance for racist views in the media, literature, and towards organizations like the Ku Klux Klan. Also, the language, living and working conditions, and Government legislations that ethnic minorities were subjected to is further evidence that the Twenties were an openly discriminatory decade. It was also during this period of grave hostility directed at ethnic groups that Americaââ¬â¢s ââ¬Ëopen door ââ¬â¢ attitude of ââ¬Å"give me your tired, your poorâ⬠¦Ã¢â¬ officially became a part of its history. During the ââ¬Å"Roaring Twentiesâ⬠, anti-immigration organizations that had been founded in the 1900ââ¬â¢s began to receive more support and became increasingly influential following the First World War. The Immigration Restriction League (I.R.L.) was one such group, which claimed to have scientific evidence that the new immigrants from southeast Europe were racially ââ¬Å"inferiorâ⬠and therefore posed a threat to the supremacy of the United States. They believed strongly in W.A.S.P. values and certainly did not wish to see them become polluted by other religions from minority groups. Not only do teenagers consume fast food, but they work for it and steal from it because they are attracted to it the most. The fast food industry provides the easiest way for young people to get started and continue to succeed in our Fast Food Nation. Our country loves fast food, there is speedy service with cheap tasty food in over one million restaurants world wide. Though we all love it, we do not like the stories behind it. In 2004, Americans spent over 110 billion dollars on fast food, thats more than higher education, computers, computer software and new cars combined (Scholosser, 3). Teenagers provide a huge role in the fast food industry. Teenagers work at these restaurants, eat at these restaurants, are objects of advertisements by these restaurants and steal from these restaurants more than any other age group. Ever since the age of three more than 75 percent of American children can recognize the face of Ronald McDonald. Since our nation is currently being raised around fast food it is only inevitable that as children grow, they only become more of a part of it everyday. The average American child begins to work around the age of 16 doing low wage low labor jobs. At anytime a teenager can walk into any fast food restaurant and apply for a job. Fast food restaurants prefer to employ teenagers because they are easily trained, less expensive to tend to than adults and are easier to control. Also since most teenagers still live at home they can afford to work for wages too low to even support an adult. No other industry in the United States had a workforce so dominated by adolescents. About two-thirds of the nations fast food workers are under the age of twenty (Scholosser, 68). Working in McDonalds is not difficult, but just tedious and long. Since most fast food restaurants are run my machines, it is up to these 17 year-old employs to push buttons and say commands. All Burger King wants is for things to get done faster, not how much effort is put into work, so teenagers feel working at Taco Bell or KFC wont be as difficult as it will a strain. Any teenager working behind the counter at any fast food restaurant is given less respect than animals at the pet store. ... she hates the job and is desperate to quit. Working at the counter she has to deal with rude remarks and complaints. She is often yelled at by strangers angry that their foods taking to long or that something is wrong with their order. One elderly woman threw a hamburger at her because there was too much mustard on it (Scholosser, 81). Though rudeness is a downside to a fast food job, there are perks for kids who do not need a lot. Many of the 200 dollar a week salary is used for teenage spending; clothes, nights out, cars and other desirable things. Teenagers run and continue the fast food work force every day, not because they have to but because its the best option available to them. Though we may not like the way the food is cooked or served; the way it tastes is still great. McDonalds makes a huge profit off of everything; soda fries and sandwiches all profit so largely, and teenagers are one of the most popular customers. A medium soda in McDonalds is $1. 29, it cost McDonalds $4. 25 per gallon of soda syrup, only about 9 cents worth of syrup is used in a medium drink, giving McDonalds almost a 95% profit. Soda consumption among teenagers has doubled within the past 20 years, reaching an average of twelve ounces of soda a day per child. (Scholosser, 54). With French fries McDonalds buy them frozen for 30 cents a pound, then sells them reheated in oil for 6 dollars a pound, pure profit pulled from the hands of teenagers. McDonalds makes billions upon billions of dollars annually by selling things for such a low price but really making the largest profit possible. Recently, fast food restaurants have become more attractive to armed robbers than a clothing store or gas station. Since fast food industries do almost all of their business in cash, others rely on credit card transactions. Robbery in fast food chains is not uncommon at all, even when most of it happens by their own employees, underage teenagers who are desperate for money. Though most of these robberies occur early in the morning or late at night when few people are working. The typical employee stole about $218 a year and according to industry studies, about two thirds of the robberies at fast food restaurants involve current or former employees. (Scholosser, 84). Employees have low pay, high turnover and know the restaurant, why not steal? McDonalds is already a billion dollar industry, many of the people think, its not going to hurt their business, they wont even notice. However these robberies have led to deaths and injuries, and make teenagers realize what horrible conditions they are working in. The liberal judicial trend in favour of applying natural justice got strengthened as a result of the kraipakââ¬â¢s decision. Facts of the case :In 1966, a service called The Indian Forest Service was constituted, the selection for which was to be made fro m among the officers serving in the forest department of the state. Section 3 of the All India Services Act, 1951 provides that the Central Government shall after consulting the Government of the States concerned to make rules for the regulation of recruitment and the conditions of the service of persons appointed to those All India Services. In pursuance of the power given under Section 3, Indian Forest Service (Recruitment) Rules, 1966 were made.The Rule 4(1) of the above mentioned Rules empowers the Central Government to recruit to the service any person from amongst the members of the State Forest Service adjudged suitable in accordance with such regulations as the Central Government may make in consultation with State Governments and the Commission. â⬠Now the regulation 3 of Indian Forest Service (Initial Recruitment) Regulations, 1956 framed under Rule 4(1) of the Indian Forest Service (Recruitment) Rules, 1966 provided for the Constitution of a Special Selection Board c onsisting of: 1.The Chairman of UPSC or his nominee. 2. Inspector General of Forests of the Government of India. 3. Joint Secretary. UOI. 4. Chief Secretary of the concerned State Government. 5. Chief Conservator of Forest of the concerned State Government. The selection Board was to be headed by the Chief Conservator of the Forest of the State while the final selections were to be made by the Union Public Service Commission (U. P. S. C).In the State of Jammu and Kashmir, a Naquishbund was appointed as the acting Chief Conservator of forest and was olso a member of the selection board for recommending the names of officers for All India Forest Service was formed, The Board recommended the names of the persons including Naquishbund. The selections as finally made by the board were accepted by the Commission. On the basis of the recommendations of the Commission, the impugned list was published. Even After review Basu, Baig and Kaulwho were supersede by naquishbund for chief conservat or of forest were not selected.It must be noted that Naquishbund was also one of the candidates for All India Forest Service. Though he did not sit in the selection board at the time his name was considered for selection but he did sit in the board when the names of Basu, Baig and Kaul were considered for selection and was also involved while preparing the list of selected candidates . Aggrieved, The Gazetted Officers Association, brought a petition to the Court challenging that the selections in question were made in contravention of the Principles of Natural Justice.Arguments Advanced : The petitioners as well as the respondents raised arguments with respect to the nature of the power conferred on the selection board. The petitioners contended that Rule 4 as well as Regulation 5 prescribes that the selections should be made after ââ¬Ëadjudgingââ¬â¢ the suitability of the officers belonging to the State service. The word ââ¬Ëadjudgeââ¬â¢ the meaning of which is ââ¬Ët o judge or decideââ¬â¢ indicates that the power conferred on the selection board was a quasi-judicial power.It was contended on their behalf that such a power is a judicial power not an administrative one and it has to be exercised in accordance with the well accepted Rules of Natural Justice, the violation of which has been rightly claimed. Naquishbund, being a candidate for Indian Forest Service cannot be an adjudicator of the same. On the other hand, the learned Attorney General on behalf of the respondents argued that the power exercised by the selection board is not a quasi-judicial power but an administrative power.To support this contention, it was further admitted that the proceedings before the selection board were not quasi-judicial because the board was not required to decide about any ââ¬Ërightââ¬â¢. The duty of the board was merely to select officers who in its opinion were suitable for Indian Forest Service. He interpreted the word ââ¬Ëadjudgeââ¬â¢ as be ing ââ¬Ëfound worthy of selectionââ¬â¢. It was also contended by the learned Attorney General that after all the selection board was only a recommendatory body. Its recommendations had first to be perused by the Home Ministry and then by the U.P. S. C. The final recommendations were made by the U. P. S. C. Therefore, grievances of the petitioners have no real basis. Keeping in mind the validity of the administrative actions taken, all that has to be seen is whether the final decision is just or not. And finally, in the form of arguendo, it was also contended by the learned Attorney General that the mere fact that one of the members of the board was biased against some of the petitioners cannot vitiate the whole selection process Analyzing the JudgmentA five judge bench of the Apex Court held that the selections made by the selection committee were in violation of principles of natural justice. The Court found the power exercised by the Selection Board as an administrative one and tested the validity of the selections on that basis. It held that the concept of rule of law would lose its importance if the instrumentalities of the State are not charged with the duty of discharging their functions in a fair and just manner. Also, it is a must to charge dministrative authorities with the duty of discharging their functions in a fair and just manner in a Welfare State like India, where the jurisdiction of the administrative bodies is increasing at a rapid rate. In the words of Hegde, J. ââ¬â ââ¬Å"The requirement of acting judicially in essence is nothing but to act justly and fairly and not arbitrarily or capriciously. The procedures which are considered inherent in the exercise of a judicial power are merely those which facilitate if not ensure a just and fair decision. It further observed that the dividing line between an administrative power and quasi-judicial power is being gradually obliterated. The Court held that the basic principle of nemo judex in causa sua was violated by appointing Naquishbund as a member of the selection board. Though he did not participate in the deliberations of the board when his name was being considered yet the very fact that he was a member of the selection board had a significant impact on the decision of the selection board and he participated in the deliberations when the claims Basu, Baig and Kaul were considered.Under such circumstances, the Court could not believe that Naquishbund could have been unbiased, the Court observed that the question is not whether Naquishbund was actually biased or not. The real question is whether there is a reasonable ground for believing that he was likely to have been biased. Further the Court observed that the question is not whether Naquishbund was actually biased or not. The real question is whether there is a reasonable ground for believing that he was likely to have been biased, earlier in Manaklalââ¬â¢s case the Court had made it clear that the test wa s not actual bias but a reasonable apprehension of bias.It held that it is difficult to prove the state of mind. Therefore in deciding the question of bias ordinary course of human conduct is taken into consideration. Owing to this, the Court observed that there was a personal interest on part of Naquishbund to keep out his rivals in order to secure his position without further challenge and so he cannot said to be impartial, fair and just while making the selection. ConclusionTherefore what emerges from this case is that although the Courts are making distinctions between the Quasi-Judicial and Administrative powers but at the same time there is one common element of fair procedure in both the cases which can be referred to as the ââ¬Ëduty to act fairlyââ¬â¢. This duty arises from the same general principles, as do the rules of natural justice. The case of A. K Kraipak v. Union of India is a landmark judgement in the development of administrative law in India and has strength ened the rule of law in this country.Hedge, J. observed that ââ¬Å"If the purpose of the rules of natural justice is to prevent miscarriage of justice one fails to see why those rules should be made inapplicable to administrative inquiriesâ⬠. In the words of Krishna Iyer, J. ââ¬â ââ¬Å"Once we understand the soul of the rule as fairplay in action ââ¬â and it is so- we must hold that it extends to both the fields. Presence of Death in Literature Essay
Literature often contains themes that allow the reader to relate to the characters. From suicide to murders, death is an inevitable theme seen time and time over not only in real life but also in many types of literary works. It is used by many authors as a main driving force behind the plot as well as a method to add emotions in various works. The presence of death is a reoccurring subject in almost every type of literary work such as novels, short stories as well as plays. Firstly, death is seen in many different novels and is present in almost every genre. Death is even present in many novels aiming for younger readers such as William Goldingââ¬â¢s ââ¬Å"Lord of the Fliesâ⬠and others. In the novel ââ¬Å"Lord of The Fliesâ⬠, death is a very common subject throughout the story as seen with the deaths of the littleââ¬â¢un, Simon and Piggy. For starters, already in the first few chapters, death makes its first appearance as one of the littleââ¬â¢uns disappears. ââ¬Å"That littleââ¬â¢un-ââ¬â¢ gasped Piggy ââ¬â ââ¬Ëhim with the mark on his face, I donââ¬â¢t see him. Where is he now?â⬠(William Golding, p. 46) The littleââ¬â¢un was earlier spotted playing in the forest near the mountain top where an accidental forest fire broke out just few moments after. The littleââ¬â¢un with the mark on his face is now nowhere to be found and is presumed dead burnt in the fire. Moreover, death is seen a second time later on in the novel when Simon is attacked by all the boys. After his encounter with The Lord of the Flies, Simon manages to make his way back to Jackââ¬â¢s feast only to find a group of boys caught up in frenzy. In their bewildered state of mind, the savage boys descended upon the innocent child thinking he was the best and violently killed him. ââ¬Å"At once the crowd surged after it poured down the rock, leapt on the beast, screamed, struck, bit, toreâ⬠( William Golding, p.169). Finally, towards the end of the book, death is seen for the third and last time when Piggy and Ralph visit the Castle Rock in hopes of retrieving Piggyââ¬â¢s glasses. However, at the castle rock, the duo encountered and unexpected twist of events which led to Piggyââ¬â¢s death after being crushed by a big boulder of rock thrown by Roger. Although death is seen multiple times in novels, it is also a recurring theme seen in other shorter literary works. Secondly, death is also seen quite often in short stories. Countless authors including Edgar Alan Poe use death as one of the main driving force in there plot line. As a matter of fact, death is seen in almost every Edgar Alan Poe short stories some examples being ââ¬Å"The Tell-Tale Heartâ⬠, ââ¬Å"The Cask of Amontilladoâ⬠and ââ¬Å"The Murders in the Rue Morgueâ⬠. To begin with, the theme of death is seen throughout the story ââ¬Å"The Tell-Tale Heartâ⬠as the main character plots to kill the old man. At the begging of the story, the main narrator explains that he can no longer stand to look into the elderly manââ¬â¢s fake eye and for that reason he must kill him. After a week of planning, the main character finally puts his plan in motion as he rushes in the old manââ¬â¢s house and crushes him to death under his own bed. ââ¬Å"He shrieked once ââ¬â once only. In an instant I dragged him to the floor, and pulled the heavy bed over him. I then smiled gaily, to find the deed so far done.â⬠(Edgar Alan Poe, p.5) Likewise, the presence of death is also present in ââ¬Å"The Cask of Amontilladoâ⬠where the main character Montresor vows revenge to his foe Fortunato for the thousand injuries and bane he has caused him in the past. In that short story, Montresor lures Fortunato in the catacomb where he is then entombed alive and left to starvation. Furthermore, death is also seen in ââ¬Å"The Murders in the Rue Morgueâ⬠but this time in a funnier and more farfetched way. In this play, an unnamed narrator and his friend investigate a crime scene only to find out that an Ourang-Outang was in fact the murderer behind the crime. The monkey wield with a razor had completely cut off the head of an old women in her own apartment. ââ¬Å"The throat of the old lady was not merely cut, but the head absolutely severed from the body: the instrument was a mere razorâ⬠(Edgar Alan Poe, p.20). Albeit death is constantly seen in many books meant to be read, it is just as present in other literary works meant to be acted out such as plays. Lastly, death is not only seen in books but it is also frequently seen in many known plays. For the past few decades, the presence of death in plays has been seen time and time over by some of the most eminent playwrights including Shakespeare. From suicide to murder, death is present in almost all of Shakespeare plays some of which are ââ¬Å"Romeo and Julietâ⬠, ââ¬Å"Macbethâ⬠and, letââ¬â¢s not forget, ââ¬Å"Hamletâ⬠. In the first place, the presence of death is seen several times throughout the play ââ¬Å"Romeo and Julietâ⬠many of which are resulted in combat such as the deaths of Mercutio, Tybalt and Paris. Although many deaths occur in the pay ââ¬Å"Romeo and Julietâ⬠, the play is most commonly known for the deaths of the star-crossed lovers, Romeo and Juliet. After Juliet drinks a potion to make her seem dead for 2 days in the hopes of escaping a forced marriage, Romeo finds her corpse. ââ¬Å"O my love, my wife! Death, that hath suckââ¬â¢d the honey of thy breath Hath had no power yet upon thy beauty.â⬠(William Shakespeare, Act 5, Scene 3). Thinking Juliet was actually dead; Romeo commits suicide by drinking poison. At Juliet awakening, she is devastated to see her loverââ¬â¢s dead body beside her and decides to stab herself to death. In the second place, death is also seen multiple times throughout the play ââ¬Å"Macbethâ⬠. In this play, in order make the witches prophecy come true, the main character Macbeth killed the King Duncan so as to inherit the throne all and become the new King of Scotland. ââ¬Å"I go, and it is done; the bell invites me. Hear it not, Duncan; for it is a knell. That summons thee to heaven or to hell.â⬠(William Shakespeare, Act 2, Scene 1) Later on in the play, Macbeth then hired murderers to kill one of his former friends as well as a many other noblemen threatening his crown. In the third and last place, the presence of death is also seen in the popular Shakespeare play ââ¬Å"Hamletâ⬠. This play is known for its many deaths throughout the plotline. In the end, almost every round character has been killed. Out of the 12, 10 were either poisoned or drowned. Thus, death is also frequently found in plays. All in all, the theme of death is a major and reoccurring subject that is present in literary works. It is often found in various types of literary works such as novels, short stories and plays. This theme has been used by some of the best authors to ever write for it evokes many emotions. However, there are many other ways the author can use to induce these. Could it really be possible that man has outgrown the need for the good old computer? However, what Atrostic and Nguyen (2006) actually meant was that the manner in which businesses use IT does matter. Hence, competitive advantage may be achieved depending on how businesses harness the power the computer. Research Question and Justification Hoskins (2011) maintained that the ââ¬Å"laptop is tailor-made for businessâ⬠(para. 1). Coincidentally, I overhead two neatly attired gentleman seated on the next table talking about their accomplishments for the day. The two appear to be sales people and were using information from their high-end laptops every now and then, either to support their asser tion or to clarify their point. It is common knowledge that most companies issue laptops to their salespeople, presumably to facilitate presentation to prospective clients. But would the issuance of laptops to employees in charge of sales or marketing produce a corresponding return on investment? This paper was conceived to gather research-based evidence of the aforementioned quandary. Specifically, the study would address two research problems: (1) What are the advantages of using laptops for people engaged in sales? and (2) Is there a relationship between use of laptops by salespeople and increase in accumulated sales? The study will also test the null hypothesis that ââ¬Å"there is no significant relationship between use of laptops by salespeople and an increase in their accumulated salesâ⬠based on a non-directional or two-tailed analysis and a 0.05 level of significance (0.05). The justification for this study rests on the premise that although empirical studies have alre ady demonstrated the link between productivity and use of computers and IT, results have been generalized for the manufacturing industry, not strictly on the sales aspect. If a direct and significant relationship is confirmed between use of laptops as an aid to sales talk and presentations and corresponding increase in accumulated sales, it is highly possible that issuance of laptops to salespeople by the companies they represent does, indeed, produce a return on investment. Hence, this paper will serve as an exploratory study to pave the way for further investigation of the association between issuance of laptops to salespeople and return on investment. This study adopted a descriptive ââ¬â exploratory methodology using a researcher-constructed survey questionnaire as the primary data collection instrument. The research instrument consists of three parts (respondent profile, advantages of using laptop for salespeople, and relationship between use of laptop increase in accumulat ed sales) and 10 items. Respondents of the study were salespeople selected using purposive sampling. It is a non-probability sampling technique wherein the sample is chosen on the basis of the researchersââ¬â¢ judgment about some appropriate characteristics of the sample, and is alternatively called judgment sampling (Zikmund & Babin, 2010). A small sample of 25 respondents served as resources for the study. Profile data were presented as frequency and percentage distributions in the form of a pie chart. Advantages of using laptop for sales people were shown as horizontal graphs. Methodology for examining the relationship between use of laptops and increase in accumulated sales is discussed in the results section of this paper. Review of Related Literature and Studies Jenkins (1999) outlined several advantages of using a laptop computer in sales in terms of: (1) professional image; (2) resource and time management; (3) information dissemination; and (4) customer interaction.
